Commercial lease forfeiture service

Navigating the complexities of commercial property management can feel stressful, especially if a tenant breaches the terms outlined in the lease agreement. If this occurs,  you possess the legal right to instruct certificated enforcement agents to initiate commercial lease forfeiture. The most common trigger for this action is the tenant's failure to adhere to the agreed-upon rental payment schedule. However, it's crucial to recognise that breaches extend beyond financial obligations. Unauthorised actions, such as subletting the premises without explicit landlord consent, significant alterations to the property without permission, or the operation of a business conflicting with permitted use clauses, also constitute grounds for forfeiture.

Our team makes sure that every step of the commercial lease forfeiture process is conducted with precision and compliance, safeguarding your legal position and ensuring a smooth transition of property control.

Recovering Control: Forfeiture of Commercial Leases

Once you have completed our online Warrant of Forfeit, you can instruct Dukes Bailiffs Limited to forfeit your commercial lease. Using our nationwide teams of certificated agents, upon receipt of your instruction, we will schedule our attendance to peaceably re-enter your property within 24 hours. The Enforcement Agents will gain access via a locksmith (outside of business/trading hours), create an inventory of goods within, before displaying possession notices, evicting the tenant and securing the property.

We will then send out a Torts (Interference With Goods Act 1977) Notice to the tenant’s last known home address, confirming our actions and advising them that they have a 14-day obligation to collect the goods within the property.
*Should the tenant fail to remove their goods,  the landlord has the right to dispose of them as they see fit. Removal and supervision of the tenant removing goods is an optional service that we provide.
